FAQs: Volcanic Ash Disruption
1. I have had to cancel my holiday and now want to claim. Do I contact CEGA and submit a claim?
You should: -
a. notify CEGA of a circumstance likely to give rise to a claim; and
b. Make every effort to seek recompense from your travel organiser or Airline Company or other party involved in your trip. Where there is a travel organiser (i.e. a package holiday) full recompense should be sought from them. Where the individual elements of the tour were arranged by you, you should seek reimbursement from the airlines and, then, address the issues of hotels or other arrangements that you have made by reviewing the cancellation provisions in the booking form or equivalent document. Failure to take every action to recover such sums (or minimise liability to pay such sums) may result in any subsequent claim amount being reduced by the amount which would otherwise have been recovered or minimised.
c. Once these steps have been taken, submit the claim for any sums that have not been recovered. The claim should include the booking form or equivalent showing the cancellation terms and the documents showing the attempts to recover or minimise the sums.
2. I am/have been stranded overseas:
a. Can I claim additional expenses, such as extended accommodation, car hire, car parking charges, medication?
Where the circumstance arises on the scheduled homeward journey (i.e. the trip is not curtailed) then you are only entitled to claim for:-
(i) Delay under Section 12 and subject to you being delayed by more than 12 hours (see policy terms and the excess); and/or
(ii) Missed departure or connection under Section 5 if your itinerary includes a booked connection for onward travel and you arrive too late to board by reason of the failure of public transport.
Where the circumstance arises in the course of trip and results in its curtailment, then the claim falls under Section 1 and its terms and conditions.
b. I am stranded overseas. Will my insurance be automatically extended and, if so, for how long?
The period of your trip insurance will be automatically extended (without any additional premium) and will continue for the period you require in order get home.
If you decide to extend your trip and do not return home as soon as you are able, you need to make contact and agree an extension (there may be an additional premium payable).
3. I want to reschedule my holiday for a later date.
a. Can I simply change the dates of my travel insurance policy? Do the Underwriters need to check any details?
No further checks are required other than a confirmation that you waive all rights to claim under the original trip, and confirmation of no change to any other material facts.
You should be aware that the terms and conditions are varied from time to time (and this experience may lead to a revision of the terms relating to closure of airspace for any reason) and the trip insurance will be subject to the terms and conditions current when the trip is commenced or the insurance incepts. If you do not accept the insurance on any revised terms, you can claim a refund of the premium instead .
b. I am not able to re-book now (some tour operators advising they are not taking any bookings in the next two weeks) . Will the Underwriters be happy to place cover on hold or would they want to refund the premium and advise that I can re-apply for cover when the new dates are known?
The cover can be placed on hold or refunded to allow you to reapply when appropriate.
You should be aware, as per 3a. above, that the insurance terms and conditions applicable to the re-booking will be the terms current at the time of the re-booking. They may change and, obviously, if the period between the planned trip and the re-scheduled trip is extended there is a reasonable likelihood of change. If you do not wish to accept cover in accordance with the amended terms applicable, you will be given a full refund.
4. My policy is now outside the 14-day cooling off period, and there are no claims made or pending . Can I cancel my policy and be refunded as I no longer expect to travel?
Yes, in the case of single trip policies where the trip has not been taken yet.
In respect of annual multi trip policies, the policies may be cancelled and underwriters will consider refunding the premium (pro rata to time on risk) taking into account, amongst other things, claims history.
5. I am looking to take out insurance for upcoming trips and want to know if they will be covered if I then have to cancel due to flight disruption because of volcanic ash, given that this is a known event?
For policies purchased after 14 April 2010:
The insurance does not cover claims arising out of circumstances manifesting themselves between the date of booking your trip and the date when you apply for your insurance. This volcanic ash disruption is such a circumstance and Insurers will, given that this circumstance was generally known from the 14th April, rely on this exclusion to deny cover for losses caused by this event on policies applied for on or after 14th April 2010.
Similarly, where this volcanic ash disruption was known both when the trip was booked and the insurance applied for, then insurers consider that they do not provide cover for this known circumstance that may lead to a claim.
For trips booked under an annual multi trip policy after 14 April 2010.
Insurers consider that they do not cover losses on an annual multi trip policy where the trip was booked after 14 April 2010 and the loss arises out of the closure of airspace that commenced on that date.
Accordingly, insurers do not consider that there is cover for any claim which relates to the current disruption due to Icelandic volcano eruptions under policies purchased or trips booked under an annual multi trip policy on or after 14 April 2010
6. Will cover be affected if future government regulations result in the closure of airspace due to an ash cloud from the same eruption or the same volcano?
Underwriters are reviewing their terms and conditions and are considering an exclusion of claims arising out of cancellation of flights due to the consequences of volcanic eruption.
If, after the airspace has re-opened, the terms remain un-amended and there is a further spate of closures of airspace arising out of a later eruption/s or unforeseen movement of the existing ash cloud, then a claim can be made subject to all terms and conditions of the policy held by an insured.
